These Terms of Service ("Terms") govern your use of this website and any services provided by Tommy Seilheimer and SEOLEVELUP LLC, an Illinois limited liability company ("we," "us," "our"). By using this site or engaging our services, you agree to these Terms. Straight talk is how we do business - so these are written to be read, not buried.
We provide digital marketing services including search engine optimization (SEO), Google Business Profile (GBP) management and optimization, generative engine optimization (GEO), answer engine optimization (AEO), GBP reinstatement, review remediation ("GBP Reputation Shield"), YouTube SEO, analytical reporting, and marketing consulting and training. The specific scope, deliverables, term and fees for any engagement are defined in your proposal, agreement or invoice, which together with these Terms forms the full agreement.
We are very good at what we do, and we show our results publicly. But Google, ChatGPT, and every other search or answer engine are third-party platforms we do not own or control, and their algorithms change constantly. No ethical provider can guarantee a specific ranking, placement, citation or result, and nothing on this site or in our communications should be read as such a guarantee. Case studies and statistics on this site are real client outcomes; they are examples of past performance, not promises of future results.
Upon full payment, deliverables we create for you (content, optimizations, reports) belong to you. Our internal methods, playbooks, tools, processes and training materials remain our intellectual property; consulting clients receive a license to use them internally, not to resell them. The content, design and branding of this website are ours and may not be copied without permission.
Our work necessarily involves platforms such as Google, YouTube, and AI answer engines. Your use of those platforms is governed by their terms, and we are not responsible for their actions, including algorithm updates, policy changes, suspensions or removals initiated by those platforms.
We keep your non-public business information confidential and expect the same for ours. We may reference the general results of our work (for example, in case studies) unless you ask us in writing not to - and if you ask, we honor it.
This website and our services are provided "as is." To the maximum extent permitted by law, we disclaim implied warranties and our total liability for any claim arising out of the services is limited to the fees you paid us for the service giving rise to the claim in the three (3) months before the claim arose. We are not liable for indirect, incidental or consequential damages, including lost profits or lost revenue.
You agree to indemnify us against claims arising from content or information you provide, your products or services, or your violation of law or third-party platform policies.
Either party may end an engagement as provided in the applicable agreement. Sections that by their nature should survive (payment obligations, IP, confidentiality, liability limits) survive termination.
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Illinois.
We may update these Terms from time to time. The effective date above reflects the latest version, and continued use of the site or services after an update constitutes acceptance.
